KITEWASH TERMS AND CONDITIONS

2. INTRODUCTORY PROVISIONS These Terms and Conditions (hereinafter “T&C”) regulate the mutual rights and obligations of the Seller and a natural person or legal entity (“Buyer”) established through a purchase agreement concluded via the online store on www.kitewash.com.

If the Buyer is a consumer (i.e. not acting within their business activity), these T&C apply in full. For business Buyers, special provisions in Article 12 apply in addition to general provisions.

These T&C are an integral part of the purchase agreement. Any provisions of the purchase agreement that conflict with these T&C shall take precedence.

3. PRODUCTS AND AVAILABILITY All products offered by Kitewash are cosmetic-grade cleaning and care solutions for kiteboarding and watersport gear.

Product listings include a description of features, use, volume, price including VAT, and availability. Availability is not guaranteed until the order is confirmed.

Prices remain valid for the duration of their display on the website.

4. ORDERING PROCESS AND CONCLUSION OF CONTRACT The website presentation is not a binding offer. The contract is concluded once the Seller confirms the Buyer’s order by email.

Steps to conclude the contract:

  1. The Buyer selects goods and adds them to the cart.
  2. The Buyer provides delivery and billing information.
  3. The Buyer selects the payment and delivery method.
  4. The Buyer confirms acceptance of these T&C and places the order.
  5. The Seller confirms receipt of the order by email.
  6. The purchase agreement is formed upon confirmation.

The Seller reserves the right to cancel the order if technical errors, incorrect prices, or stock issues occur.

5. PAYMENT TERMS The Buyer may pay for goods using the following methods:

  • Online payment via secured payment gateway (e.g. Shoptet Pay, card payments)
  • Bank transfer to the Seller’s account (details provided during checkout)

The goods will be dispatched only after full payment is received. An electronic invoice will be issued and sent to the Buyer’s email.

The Seller is not VAT payer.

6. DELIVERY CONDITIONS Delivery is available within the EU and in some worldwide destiantions. Shipping fees are shown before checkout and vary by destination and method.

Typical dispatch time is within 3 business days of payment confirmation. Estimated delivery times depend on the carrier.

Ownership transfers to the Buyer upon full payment and physical receipt of the goods. The risk of loss passes upon handover to the carrier.

The Buyer must check the shipment upon receipt and report any transport damage to the carrier immediately.

7. RIGHT OF WITHDRAWAL (FOR CONSUMERS) Buyers who are consumers have the right to withdraw from the contract within 14 days of receiving the goods.

To qualify:

  • Products must be unused, unopened, and in original packaging.
  • The Buyer must notify the Seller in writing (email or postal letter).
  • Return costs are borne by the Buyer.
  • The Seller will refund payment (including delivery costs equal to the cheapest offered method) within 14 days of receiving the returned goods.

Exceptions: Cosmetic products that have been opened or used cannot be returned due to hygiene and health protection.

8. COMPLAINTS AND WARRANTY The Buyer has the right to file a complaint for defective goods within 24 months of delivery, in accordance with Czech Civil Code and consumer protection law.

Contact info@kitewash.com with your order number and description of the defect. The Seller will respond within 30 days.

Remedies may include:

  • Replacement
  • Repair
  • Reasonable discount
  • Refund (if the product cannot be repaired or replaced)

The Seller is not responsible for damage due to misuse, improper storage, or handling against instructions.

9. LIABILITY The Seller is not liable for damages arising from improper use or maintenance of the products. Always follow instructions provided on the packaging or the website.

10. DISPUTE RESOLUTION These Terms and all contracts are governed by Czech law. Any disputes shall be resolved amicably or via:

  • Czech Trade Inspection Authority (https://www.coi.cz)
  • EU Online Dispute Resolution Platform (https://ec.europa.eu/consumers/odr)

11. PRIVACY AND COOKIE POLICY The Seller processes personal data in accordance with GDPR (Regulation EU 2016/679). Full Privacy Policy is available at: https://www.kitewash.com/privacy-policy

Cookies are used to enhance the website experience. Non-essential cookies are stored only with user consent.

12. SPECIAL TERMS FOR BUSINESS BUYERS Buyers acting within the scope of their business:

  • Are not entitled to a 14-day withdrawal right.
  • Are subject to different warranty terms as per the Civil Code.
  • Take on risk of change of circumstances (Section 1765(2) of the Civil Code).
  • Are responsible for inspecting goods upon receipt without delay.

13. FINAL PROVISIONS The Seller may revise these Terms and Conditions at any time. The version in effect at the time of purchase shall apply.

If any provision is found to be invalid, it does not affect the validity of the remaining terms.

These T&C are archived electronically and are not publicly accessible.
